When a subpoena cannot be served on a respondent in a protection order case because the status of the respondent is not known, the petition for protection may be carried forward (National Institute of Justice, 1990).

2. The dependent variable is defined as the number of ex parte protection orders granted in result to adult abuse protection order requests filed with an appropriate court in St. Louis County, Missouri in a calendar year.

As the data presented in Table 3 and portrayed in Chart 2 indicate, the proportion of petitions for full protection orders that have been dismissed for reasons of non subpoena of respondent when respondent locating is known or the failure of the petitioner to appear in court has been trending upward. This upward trend has been quite dramatic all over the past two years. The data presented in Table 3 are converted to percentages of total petitions for ex parte protection orders and presented in Table 4. Table 4 may be found in the Appendix to this study.
